Section 180-13-001 - SCOPE AND AUTHORITY

The regulations in this Chapter establish requirements for packaging, preparation for shipment, and transportation of radioactive material. The regulations are authorized by and implement the Nebraska Radiation Control Act, Nebraska Revised Statute (Neb. Rev. Stat.) §§ 71-3501 to 71-3520.10 Code of Federal Regulations (CFR) as published on January 1, 2006 and 49 CFR as published October 1, 2006 and referred throughout this chapter are incorporated by reference and available for viewing at the Department of Health and Human Services, Office of Radiological Health, 301 Centennial Mall South, Lincoln, Nebraska 68509-5026. The regulations in 180 Nebraska Administrative Code (NAC) 13 apply to any licensee authorized by specific or general license issued by this Department to receive, possess, use, or transfer licensed material, if the licensee delivers that material to a carrier for transport, transport the material outside the site of usage as specified in the Department's license, or transport that material on public highways. No provision of 180 NAC 13 authorizes possession of licensed material.
