Section 175-4-001 - SCOPE AND AUTHORITY

These regulations govern licensure of assisted-living facilities. The regulations are authorized by and implement the Assisted-Living Facility Act, Neb. Rev. Stat. §§ 71-5901 to 71-5908 and the Health Care Facility Licensure Act, Neb. Rev. Stat. §§ 71-401 to 71-459.

001.01 Assisted-living facility does not include a home, apartment, or facility where:

1. Casual care is provided at irregular intervals; or

2. A competent person residing in such home, apartment or facility provides for or contracts for his or her own personal or professional services if no more than 25% of persons residing in such home, apartment or facility receive such services.
