Chapter 8 - FINANCIAL ASSURANCE CRITERIA: SOLID WASTE MANAGEMENT FACILITIES
Section 132-8-021 - Forfeiture

If the owner or operator of a solid waste management facility fails to properly implement the applicable closure or post-closure plan or remedial action program, or does not comply with a directive from the Department to implement the applicable closure or post-closure plan, or remedial action program, or the Department deems the solid waste management facility abandoned, the Department shall declare all or any appropriate part of the financial assurance as forfeited. For purposes of this chapter, abandonment shall mean the failure to initiate closure within thirty (30) days after receipt of the final volume of waste.
