Section 92-20-008 - Provisions for Notice and Hearing

008.01 When the Commissioner makes a recommendation to the Board for an institution to be placed on probation or for the denial of continuing approval, notice of the recommendation and of the right to request a hearing within thirty (30) days after receipt must be given to the institution by certified mail. Copies must be sent to the certification officer and the chief executive officer, if known. This notice must specify the basis for the recommendation and the tentative date that the Board will consider the recommendation unless a formal hearing is requested.

008.02 If the institution files a request for a formal hearing within thirty (30) days after receipt of the recommendation, the Board must schedule a hearing date. If no formal hearing is requested, the recommendation must be considered by the Board and adopted or modified by order of the Board.

008.03 All hearings arising under this chapter must be conducted in accordance with the hearing procedures of Chapter 61 of Title 92 of the Nebraska Administrative Code.
