Section 273-9-013 - LEAVE OF ABSENCE

Agency heads may grant employees (including temporary employees) an unpaid leave of absence, not to exceed one year (except for military service and some worker's compensation cases), when such absences will not interfere with the best interests of the State. An unpaid leave of absence longer than a year needs Director approval.

013.01 During the leave of absence, the temporarily vacated position may be filled by either employing a temporary employee or assigning another qualified employee to assume the duties of the position.

013.02 Sick and vacation leave will not accrue during a leave of absence.

013.03 Sick and vacation leave earned but unused prior to leave of absence will be carried forward upon the employee's return.

013.04 The employee's service date will be adjusted for the total of non-pay absences in excess of 14 consecutive calendar days, except when an employee is still eligible for worker's compensation payments.
