Section 273-5-004 - TRANSFERS

In the case of personnel actions (promotion, lateral move or move to a lower position) employees may be required by the agency head to serve a probationary period. (Note -- this is not another original probationary period.) This probationary period in no way affects the grievance rights of an employee. The length of the probationary period is at the agency head's discretion, but shall not exceed six months, beginning on the date of the transfer. If a transferred employee under probation is not performing adequately in a new position, the employee may be reverted to the previous position and pay rate at the sending agency head's discretion. The employee may also apply for any open position for which he/she is qualified to hold. If no other position is available for transfer, the agency head may reassign the duties of the employee, reclassify the employee to a classification of a lower pay range or terminate the employee at the agency head's discretion.
