Section 273-14-009 - RULES OF EVIDENCE AND COSTS

Any party to a formal hearing before the State Personnel Board or hearing officer, from which a decision may be appealed to the courts of this state, may request that the parties bound by the rules of evidence applicable in district court by delivering to the DAS-Employee Relations Division, at least three days prior to the holding of the hearing, a written request. Such request will include the requesting party's agreement to be liable for the payment of costs resulting from such request and upon any appeal or review thereof, including the cost of court or court reporting services which the requesting party will procure for the hearing. There will be no charge to the employee for hearing officer services in cases where the employee is covered by the Personnel Rules.
