Rule 44.12.106 - ELECTED PUBLIC OFFICIALS

(1) To provide guidance and certainty in identifying who is a public official as defined in 5-7-102(16), MCA, and an elected state official as defined in 5-7-102(7), MCA, the following are deemed to be an elected public official acting in his/her official capacity for state government:
(a)
the governor;
(b) the lieutenant
governor;
(c) the secretary of
state;
(d) the attorney
general;
(e) the state
auditor;
(f) the superintendent of
public instruction;
(g) public
service commissioners;
(h) justices
of the supreme court;
(i) district
court judges;
(j) the clerk of the
supreme court; and
(k)
legislators.
