(1) An entity that initiates a placement of a charge for a product or service on a customer's telephone bill in violation of these rules, or that cannot provide documentation that the billing for the product or service was initiated in compliance with these rules, is liable to the customer for all customer-paid charges and fees related to the product or service being billed on the customer's telephone bill by a telecommunications carrier, other entity, or agent of either, during the period of the unauthorized billing, not to exceed six continuous months of unauthorized billing.

(2) Penalties for violation are as provided in 69-3-1305, MCA.
