(1) A family is not eligible for TANF Cash Assistance if the family includes an adult who has received cash assistance in a program funded under the Temporary Assistance for Needy Families Block Grant in any state or states, including tribal programs, for 60 months or more, whether or not the months are consecutive, unless all adults in the filing unit qualify for TANF extended benefits. However, in calculating the number of months that an adult has received such assistance, the department shall not count any month when the person received assistance if during that month:

(a) the person was a minor child and was not the head of a household or married to the head of the household; or

(b) the person was an adult and lived within the exterior borders of an Indian reservation or an Alaskan native village where at least 50% of the adults were not employed.
(i) A person living within the exterior borders of an Indian reservation is considered to be living in Indian country.
