(1) Following an employer's notice of intent to discharge a claimant, the department shall determine the reason for the separation in the following manner:
(a) when an employer's notice of discharge is
valid, the department shall consider the claimant to have been discharged,
regardless of whether the claimant left employment voluntarily prior to the
intended date of termination; or
(b) when an employer attempts to retract a
valid notice of termination and the claimant does not accept the retraction,
the department shall consider the claimant to have been discharged.
(2) When an employer's notice of discharge is not valid and the claimant left solely in response to the invalid notice, the department shall consider the claimant to have left employment voluntarily.
