Rule 24.29.3103 - DEFINITIONS

As used in subchapter 31, the following definitions apply unless the context clearly indicates otherwise:

(1) "Claim records" means documents related to the medical condition and work status of the worker. The records include but are not limited to notes and reports of health care providers, and any additional information relevant to the reopening of medical benefits. The term does not include medical billing records.

(2) "Dismissed" means the petition was found ineligible for medical review or has been withdrawn at the injured worker's request.

(3) "Petition" means the department-provided form upon which a party requests that medical benefits terminated by statute be reopened.

(4) "Reopened" means medical benefits terminated by statute and which are now to be furnished by the insurer as recommended in the medical report.
