Rule 24.26.648 - DISAFFIRMANCE OF REPRESENTATION BY BARGAINING REPRESENTATIVE

(1) After one year from the date of certification by the board or recognition by an employer of the bargaining representative and after the filing of a petition for decertification by an employee or group of employees an incumbent bargaining agent may submit to the board an affidavit of disaffirmance of representation stating it no longer desires to represent the bargaining unit in question.

(2) Upon the filing of such an affidavit the bargaining representative's name shall be removed from the ballot in the decertification election. If no other bargaining representative appears on the ballot, no election shall be conducted.
