Rule 24.159.413 - APPLICANTS WITH CRIMINAL CONVICTIONS

(1) The board incorporates ARM 24.101.406 by reference with the following modifications:
(a) Nonviolent
misdemeanor convictions involving use or sale of drugs or alcohol in (5)(a) are
nonroutine and will be processed under NEW RULE XXI (ARM 24.159.413 ) if those
convictions totaled two or more for which the conviction date is five years or
less from the application date.
(b)
Nonviolent felony convictions involving use or sale of drugs or alcohol in
(5)(b) are nonroutine and will be processed under NEW RULE XXI (ARM 24.159.413
if the conviction date is ten years or less from the application
date.
(c) Violent misdemeanor or
felony convictions in (6) are routine if the conviction date is more than ten
years before the application date, unless the applicant is still in custody due
to the conviction or staff otherwise determines the applicant engaged in
egregious conduct implicating risk to public safety.
