(1) The board incorporates ARM 24.101.406 by reference with the following modifications:
(a) Nonviolent
misdemeanor convictions involving driving under the influence (DUI) in (5)(a)
are routine if the conviction date is more than five years before the
application date, unless the applicant is still in custody due to the
conviction.
(b) Nonviolent felony
convictions under (5)(b) are routine if the conviction date is more than ten
years before the application date, unless the applicant is still in custody due
to the conviction.
