(1) All state surface waters located wholly within the boundaries of designated national parks or wilderness areas as of October 1, 1995, are outstanding resource waters (ORWs). Other state waters may be designated an ORW by the department following the procedures in 75-5-316, MCA, subject to approval by the legislature.
