PURPOSE: This rule complies with the requirements of section 536.023, RSMo and sets forth the selection process, term, powers and duties of the presiding commissioner.

(1) Presiding Commissioner. The Administrative Hearing Commission shall choose one (1) commissioner to be presiding commissioner by majority vote of the commissioners. The presiding commissioner shall serve a term of one (1) year ending June 30, or until a successor is chosen, whichever is later. The presiding commissioner shall have the managerial and budgetary powers and duties that the commission assigns by majority vote of the commissioners.

(2) Managing Commissioner. The Administrative Hearing Commission may choose one (1) commissioner to be managing commissioner by majority vote of the commissioners. The managing commissioner shall serve a term of one (1) year ending December 31, or until a successor is chosen, whichever is later. The managing commissioner shall have the powers and duties that the presiding commissioner assigns.
