Rule 6-3-5.34 - ESP's Certification of Meeting Minimum Requirements

In order to be eligible for further evaluation, the ESP shall issue the following certified sworn statement by an individual possessing the authority to bind the ESP asserting that the ESP meets the minimum qualifications required to be prequalified for these services. The signed and notarized certification shall state as follows:
A. The ESP certifies that neither it nor its principals are currently ineligible, debarred, suspended, or otherwise excluded from bidding or contracting with the State of Mississippi, any other state, the federal government, or any agency, subdivision, department, or authority of the foregoing.
B. The ESP certifies that neither it nor its principals have been terminated for cause, are currently in default, and/or have been declared in default on any energy services contract, energy performance contract or shared savings contract within the five (5) years preceding the submittal of this response.
C. Certify that your company does not owe the State of Mississippi any taxes.
D. The ESP certifies it has all necessary, valid and current licenses to do business in the State of Mississippi.
E. The ESP certifies it has completed no fewer than five (5) ESCs, GESPCs or SSCs savings agreements within the last five (5) years and that each of these projects has been paid for or has a minimum of one (1) year repayment and savings performance history if financed through an energy performance contract or shared savings contract.
F. The ESP certifies that it has the capacity to meet the insurance and bonding requirements required by the public entity to perform their services including Performance and Payment Bonds, pursuant to Section 31-5-51, Mississippi Code of 1972, as amended.
G. The ESP certifies it has submitted a complete and accurate response to this RFQ using the instructions and format described in Parts I and II.
