Any living person born in the state of Mississippi whose birth has not been registered with the Office of Vital Records of the Department of Health, may file a delayed registration of birth by affidavit, with proof, or by court order. A delayed birth certificate form must be used if the birth is not registered within one year of the date of birth. Delayed birth registrations determined to be fraudulent, in whole or in part, shall not be filed and the record and all documents pertaining to the record shall be turned over to the appropriate law enforcement agency for investigation and to the district attorney in the county of venue for prosecution.
