When a birth occurs at a place other than a licensed healthcare facility the birth shall be classified as a home birth. The certificate for such a birth shall be prepared and filed in accordance with Rule 3.2.4 of this publication. A birth certificate for a home birth determined to be fraudulent, in whole or in part, shall not be filed and the record and all documents pertaining to the record shall be turned over to the appropriate law enforcement agency for investigation and the district attorney, in the county of the alleged birth, for prosecution.
