Rule 15-5-85-3.1.2
A certificate of live birth for each birth which occurs in this state shall be filed with the Office of Vital Records of the Department of Health within five days after such birth and shall be registered if it has been completed and filed in accordance with this rule. Births registered within one year after the date of occurrence shall be registered on the standard certificate of birth form. Births which occur in this state but outside a licensed healthcare facility with no licensed healthcare provider in attendance or available immediately after the birth shall meet the requirements specified in the Home Births section (Rule 3.6.1) of this subpart prior to being deemed as registered or filed. Births registered one or more years after the date of the event shall meet the requirements specified in the Delayed Registration of Birth section (Rule 3.7.1) of this subpart prior to being deemed as registered or filed.
