Rule 15-21-78-1.1.17 - Hearings and Judicial Review

In any proceedings under these regulations for granting, denying, suspending, revoking, or amending any license or registration, or for determining compliance with rules and regulations of the Agency, the Agency shall afford an opportunity for a hearing upon the request of any person whose interest may be affected by the proceeding, and shall admit any such person as a party to such a hearing. Any order or decision of the Agency regarding the granting, denying, suspending, revoking or amending any license or registration as provided by these regulations, shall be subject to review by writ of certiorari to the Circuit Court of Hinds County, Mississippi, at the instance of any party in interest. The filing of the appeal shall, in all cases, be with a bond, with security for all costs, as approved by the judge or clerk of the court, and shall operate as a stay of any such order or decision until the court directs otherwise. The court may review all the facts and, in disposing of the issue before it, may modify, affirm or reverse the order or decision of the Agency in whole or in part.
