Rule 13-4-3.4 - Ex Parte Communications

(a) Unless required for the disposition of ex parte matters authorized by law:
1. A party or his representative shall not
communicate directly or indirectly in connection with any issue of fact or law
related to a proceeding under this regulation, with the hearing examiner or any
member of the Commission, except upon notice and opportunity to all parties to
participate; and
2. The hearing
examiner or a member of the Commission shall not communicate, directly or
indirectly, in connection with any issue of fact or law related to a proceeding
under this regulation, with any party or his representative, except upon notice
and opportunity to all parties to participate;
(b) This section shall not preclude:
1. The hearing examiner or any member of the
Commission from consulting with Commission counsel or supervisory counsel
concerning any matter before the Commission; or
2. A party or his representative from
conferring with the hearing examiner, the Chairman, or Commission counsel
concerning procedural matters that do not involve issues of fact or law related
to the proceeding. (Adopted: 09/25/1991.)
