Rule 13-2-3.2 - Waiver Of Privilege

An applicant shall waive any statutory or common law privilege afforded by the laws of the State of Mississippi or of any other jurisdiction in which the applicant or any information pertaining to the application is located. Refusal to waive such a privilege shall constitute grounds for denial of the application. An applicant may claim any privilege afforded by the Constitution of the United States, or of the State of Mississippi, in refusing to answer questions by the Executive Director and the Commission. Since the burden of proving his qualifications is upon the applicant, however, a claim of privilege with respect to any testimony or evidence pertaining to an application may constitute sufficient grounds for denial.
