Part 3900.8500 - EMPLOYEE TRANSFERS FROM OTHER PUBLIC JURISDICTIONS

Subpart 1. Permitted transfers or demotions.
The commissioner may approve the transfer or voluntary demotion of an employee from another public jurisdiction if the following conditions are met:
A. the employee is
currently working in the other public jurisdiction or has worked in the other
public jurisdiction within the preceding year;
B. the position held by the employee in the
other public jurisdiction is covered by a personnel system with competitive
entry and promotion standards, comparable in duties and responsibilities to the
Minnesota classified position, and compensated at a level similar to or higher
than the position to which the employee is being transferred or demoted;
and
C. the employee meets the
qualifications for the position to which the employee is being transferred or
demoted.
Subp. 2. Disallowed transfers.
The commissioner shall not approve the transfer of an employee to a position funded by a grant-in-aid program from a public jurisdiction without a federally approved merit system.
