Part 9505.2210 - ADMINISTRATIVE SANCTIONS FOR VENDORS

Subpart 1. Authority to impose administrative sanction.

The commissioner shall impose administrative sanctions or issue a warning letter if the department's investigation under part 9505.2200 determines the presence of fraud, theft, abuse, or error in connection with a program or if the vendor refuses to grant the department access to records as required under part 9505.2185.

Subp. 2. Nature of administrative sanction.

The actions specified in items A to C are administrative sanctions that the commissioner may impose for the conduct specified in subpart 1.

A. For any vendor, the actions are:
(1) suspending or terminating the vendor's participation;

(2) suspending or terminating the participation of any person or corporation with whom the vendor has any ownership or control interest;

(3) requiring attendance at education sessions provided by the department;

(4) requiring prior authorization of services; and

(5) lockout of the vendor's participation in a program.

B. For a provider, the actions in item A, and in addition:
(1) requiring a provider agreement of limited duration;

(2) requiring a provider agreement which stipulates specific conditions of participation; and

(3) review of the provider's claims before payment.
