A manager of a watershed district or a member of a joint powers board may be removed from the position by the appointing authority before term expiration for violation of a code of ethics of the watershed management organization or appointing authority or for malfeasance, nonfeasance, or misfeasance, after being provided an opportunity for hearing before the appointing authority. Managers holding the position as an elected official who are not reelected, or are serving an indefinite term at the pleasure of the appointing authority, may be removed by the appointing authority at will. A decision of the appointing authority may be appealed to the Board of Water and Soil Resources.

Subpart 1. Removal for violations.

A manager of a watershed district or a member of a joint powers board may be removed from the position by a majority vote of the appointing authority before term expiration for violation of a code of ethics of the watershed management organization or appointing authority or for malfeasance, nonfeasance, or misfeasance, after being provided an opportunity for a hearing before the appointing authority.

Subp. 2. Removal; elected officials, at-will members.

A member of a joint powers board who is holding the position as an elected official who is no longer serving in that position or who is serving an indefinite term at the pleasure of the appointing authority, may be removed by the appointing authority at will.
