The commissioner, on the commissioners motion or a partys motion, must dismiss a petition if the commissioner lacks jurisdiction. The commissioner must dismiss a petition:
A. by granting summary judgment after reviewing the parties written briefs without a hearing; or
B. after conducting a hearing according to part 7315.2100.
