Subpart 1. IFC section 109.1.
IFC section 109.1 is amended to read:
SECTION 109
APPEALS
109.1
Appeals to state fire
marshal. As outlined in Minnesota Statutes, section
299F.011,
subdivisions 5 and 5b, any person may appeal an order issued to them by the
state fire marshal or action taken by the local governing body on issues
regulated by this code. Appeals can be made to determine the suitability of
alternate materials and types of construction, to provide for reasonable
interpretations of the provisions of this code, and to grant variances from
orders issued by representatives of the state fire marshal. Persons wishing to
present matters for appeal shall do so in writing and, in the case of persons
who have received written orders, applications for variances shall be made
prior to the expiration of the orders. Orders shall not be considered to be
expired until any time extensions granted by the state fire marshal have
elapsed. The state fire marshal shall not accept applications for variances
after criminal action for noncompliance has been initiated pursuant to
Minnesota Statutes, section
299F.011,
subdivision 6.

IFC sections 109.2 and 109.3 are deleted.
