Section R. 397.91 - Waiver of state aid eligibility requirements

Rule 91.

(1) The department, through the department director, may grant a limited waiver to a cooperative library or public library for a particular eligibility requirement prescribed by these rules for the receipt of state aid funds, if the public library or cooperative library requests the waiver in writing and the public library board or cooperative board shows that the failure to meet a requirement was not a continuing violation but a temporary condition. The department director may delegate the authority to the state librarian to grant waivers in writing.

(2) The department may consider waiver in cases where the failure to comply with an eligibility requirement prescribed by these rules is due to unforeseen circumstances beyond the requester's control.

(3) The department shall not grant a waiver unless the applicant submits an action plan for compliance before the end of the next reporting year.

(4) The department shall issue a written decision concerning each waiver request within 30 days of receiving the request.

(5) The department's decision is binding.

(6) A separate waiver request is required for each state aid filing year.
