Section 70.20 - Exceptions

(1) No permittee conducting field investigation under permit as provided by 950 CMR 70.00 shall be authorized to excavate human skeletal remains. The provisions of 950 CMR 70.20 do not supersede other legislative and regulatory requirements regarding the discovery, reporting, excavation or reinterrment of human skeletal remains.

(2) Human skeletal remains shall be excavated only after securing a Special Permit from the State Archeologist. The State Archeologist shall issue a Special Permit only if the remains are imminently and irrevocably threatened by non-archeological activities. Avoidance of burials and preservation insitu are preferred alternatives.
