Section 6.12 - Limitations on Implied Warranties Prohibited

It is an unfair or deceptive act for a seller of a product purchased for personal, family, or household purposes to use any words or phrases which state or imply a limitation on the implied warranties of merchantability and fitness for a particular purpose, including phrases such as, "as is", "with all faults", and "all sales final". However, a seller may adopt an "all sales final" return policy, if it clearly and conspicuously discloses that policy in its advertisements and in-store signs and includes in such disclosures the following or substantially similar language: "All Sales Final Except for Defective or Non-Conforming Goods".
