(1) In order to achieve compliance with requirements of federal law including, but not limited to, 42 U.S.C. § 300gg-19 the Commission delegates external appeals procedures to the Commission's self-insured plan administrators. Any person who is aggrieved by a final decision of one of the Commission's self-insured plan administrators about benefits, may appeal in writing to the plan administrator.
(2) Notwithstanding 805 CMR 9.25(1), eligibility decisions by the Commission are final and not subject to appeal procedures under 805 CMR 9.25.
