Title 540 CMR 7.00 - Minimum Standards For Construction and Equipment of School Buses and Minimum Standards For School Pupil Transport Vehicles
Section 7.10 - Request for a Temporary Waiver from the Passenger Capacity Requirement of School Pupil Transport Vehicles

Upon application, the Registrar may temporarily waive compliance with the ten-passenger seating capacity requirement in 540 CMR 7.02(4) and 7.09(1) for vehicles that have a seating capacity of 11 passengers in addition to the operator, which otherwise comply with 540 CMR 7.00 and 540 CMR 21.00: Semiannual Safety Inspection of School Pupil Transport Vehicles, and which were registered as school pupil transport vehicles on or after June 30, 2020. Any such waivers shall expire no later than August 31, 2021, and may be revoked at any time in the Registrar's sole discretion. The Registrar shall establish policies and procedures setting forth the terms and conditions for requesting and obtaining waivers under 540 CMR 7.10.
