Section 2.08 - Operation by Minors

(1) Safety Certificate. Any person of at least 12 years of age and less than 16 years of age shall satisfactorily complete a training course in boating safety approved by the National Association of State Boating Law Administrators. Courses approved include those sponsored by the Division of Law Enforcement, boating agencies of other states in the U.S.A., the United States Coast Guard Auxiliary, the United States Power Squadron, or any other entity approved by the Director. Any such person who satisfactorily completes said course will be issued a safety certificate, which shall be in possession when operating a motorboat and available for inspection by empowered law enforcement officers.

(2) Exception. The provisions of 323 CMR 2.08(1) shall not apply if the person (minor) who is operating the motorboat is accompanied on-board and directly supervised by a competent person 18 years of age or older.

(3) Minimum Age. No person under 12 years of age may operate a motorboat on the waters of the Commonwealth, unless accompanied on board and directly supervised by a competent person 18 years of age or older.
