Title 314 CMR 16.00 - Notification Requirements to Promote Public Awareness of Sewage Pollution
Section 16.08 - Waivers

Upon application by a permittee, the Commissioner may issue a written waiver of any requirement under 314 CMR 16.00 related to a permittee's outfall; provided that:

(a) the outfall is decommissioned; or

(b) there has not been significant discharge from the outfall, as determined by the Department, during the preceding five years; and provided that the Commissioner determines that waiver will not pose a substantial threat to public health or to the environment.

The Commissioner may include specific conditions in any written waivers, which shall be valid for not more than five years, or for such shorter period of time as determined by the Commissioner.
