Section 9.25 - Expiration and Renewal

(1) Expiration.
(a) Any
license, permit, or legislative authorization shall expire as to all work
licensed, permitted, or authorized which is not completed within five years of
the date thereof, or such other period of time specified therein; provided,
however, that for good cause shown the Department may extend, without public
hearing or notice, the construction period of the license, permit, or
legislative authorization for one or more one year periods upon written request
of the licensee or permittee.
(b)
All licenses or permits shall expire upon reaching the term, if any, stated in
the license or permit or any extension thereof.
(c) Any license shall expire if the fill or
structures are abandoned and not used for the purpose for which they were
licensed for a period of five consecutive years or more.
(2) Renewal of Licenses and Permits. A renewal may be granted for a term of years not to exceed that authorized in the original license or permit, in accordance with 310 CMR 9.15, upon written application by the licensee or permittee and in accordance with the procedures for amendments set forth at 310 CMR 9.24.
