The Secretary shall make a final decision as to whether or not to designate a nominated area within 60 days of the public hearing held pursuant to 301 CMR 12.07. The Secretary shall designate an ACEC only after finding that, on the basis of the information presented by the nominating party and at the public hearing and after a review of the factors listed in 301 CMR 12.08(1) through (10), the area is of critical environmental concern to the Commonwealth.
