Section 5.17 - Inspection of Facilities and Requirements for Corrective Action

(1) Inspection of Dental Facilities. The Board or its designee(s) may visit a dental practice at any time without prior notice and conduct an inspection to determine compliance with state law M.G.L. c. 112, §§ 43 through 53 and § 61 and 234 CMR and any rule, advisory or written policy adopted by the Board related to the practice of dentistry, dental hygiene, or dental assisting.
(2) Deficiency Statement. Following a Board inspection during which any violation of M.G.L. c. 112, §§ 43 through 53 and 234 CMR 2.00: Purpose, Authority, Definitions is found, the Board or its designee(s) may prepare a deficiency statement citing any and all violations observed, a copy of which shall be sent to the licensee for response.
(3) Plans of Correction. The licensee shall submit to the Board a written plan of correction for violations cited in a deficiency statement within the time specified by the Board. The plan of correction shall set forth, with respect to each deficiency, the specific corrective step(s) to be taken, a timetable for such steps, and the date by which compliance will be achieved. The timetable and the compliance dates shall be consistent with achievement of compliance in the most expeditious manner possible. A plan of correction which does not meet the requirements of this section shall be considered unacceptable by the Board and may be returned to the licensee for further correction.
