Section 41.23 - Appeals

(1) A Carrier aggrieved by a Decision and Order on a Rate Filing or a Revised Rate Filing issued in a Proceeding conducted by a Presiding Officer designated by the Commissioner, which the Commissioner has no t affirmed, may appeal t he decision to the Commissioner pursuant t o M. G. L. c. 26, § 7.

(2) A Carrier aggrieved by a Decision and Order on a Rate Filing or a Revised Rate Filing, which the Commissioner has affirmed, may, within 20 days of the decision, file a petition in the Supreme Judicial Court for Suffolk County for a review of such decision. The Supreme Judicial Court's review on the merits shall be limited to he record of the proceedings before the Commissioner and shall be based upon the standards set forth in M.G.L. c. 30A, § 14(7).
