Payment for the services described in 130 CMR 437.000 is made only to hospices participating in MassHealth on the date of service.
(A) In State. To participate in MassHealth, a Massachusetts hospice must
(1) be certified as a provider of hospice
services under the Medicare program, as defined in 42 CFR Part 418;
and
(2) be licensed as a hospice
program by the Massachusetts Department of Public Health pursuant to M.G.L. c.
111, § 57D and 105 CMR 141.000: Licensure of Hospice
Programs.
(B) Out of State. To participate in MassHealth, an out-of-state hospice must
(1) be certified as
a provider of hospice services under the Medicare program, as defined in 42 CFR
Part 418 ;
(2) be licensed by the
appropriate licensing agency in its state (as applicable); and
(3) participate in the Medicaid program in
its own state.
