Section 101.00 - General Provisions

(1) Title. 120 CMR shall be known as the regulations of the Massachusetts Parole Board.

(2) Authority. The Massachusetts Parole Board is required to promulgate regulations, rules, policies, and procedures governing the performance of its duties. M.G.L. c. 27, § 5.

(3) Regulations Do Not Limit Statutory Authority. Nothing contained in 120 CMR will be interpreted to limit the authority granted to the Massachusetts Parole Board by any applicable provision of the Massachusetts General Laws.

(4) Cancellation. All previous Massachusetts Parole Board rules and regulations regarding the organizational and legal basis of the Massachusetts Parole Board are hereby canceled.

(5) Severability. If any section, subsection, sentence, clause or phrase contained in120 CMR is for any reason held to be unconstitutional, contrary to statute, in excess of the authority of the Massachusetts Parole Board, or otherwise inoperative, such decisions will not affect the validity of any other section, subsection, sentence, clause or phrase of 120 CMR.
