Section 4.35 - Institutional Settings: Coordination between Agencies

(1) The Department shall make its employees available to testify at administrative hearings held by EEC, DESE, DMH, DDS, or DYS in connection with matters reported by the Department to any of said agencies pursuant to 110 CMR 4.34.

(2) After the Department provides a copy of the 51A report and 51B response to any agency pursuant to 110 CMR 4.34, the agency in question is responsible for any further action to ensure that adequate steps have been or will be taken to prevent re-occurrence of incidents of abuse or neglect of children in the institution in question. The Department remains responsible for monitoring the quality of services for any children who are in the care or custody of the Department and who are placed by the Department at the institution in question.
