Section 706.690 - Exceptions to Advance Vendor Notification

(A) The Department is not required to send a written notice to a vendor one month in advance of a vendor payment termination when:
(1) the client has verified, by the
Board of Health or appropriate code enforcement authority, the existence of a
health and/or safety code violation;
(2) the client's assistance is
terminated;
(3) the client's
monthly grant amount is less than the amount of the vendor payment;
(4) the client has verified that the last
month's rent was paid as part of a lease agreement;
(5) the TAFDC client is participating in the
Full Employment Program as provided in 106 CMR 707.180: Full Employment
Program; or
(6) the local
office director or designee has waived this requirement as provided in
106 CMR
706.680(B)(2).
(B) In cases of these exceptions, the Department is required to send a written notice to the vendor no later than the date of termination of the vendor payment.
