Section 802.510 - Deficiencies

(1) A deficiency means there is a violation of 105 CMR 802.000 or an administrative requirement, protocol, or order of the Department. The Department may find a deficiency exists based upon information received by the Department, such as information received through the complaint procedure, as set forth in 105 CMR 802.500.

(2) A deficiency may result in the following enforcement action:

(a) an advisory letter, a letter of deficiency, a notice of serious deficiency, a cease-and-desist order, or a letter of reprimand;

(b) a request to submit a written plan of correction as set forth in 105 CMR 802.520;

(c) a correction order as set forth in 105 CMR 802.530; or

(d) a denial, suspension, revocation, or refusal to renew a registration.
