Title 105 CMR 170.000 - Emergency Medical Services System
Section 170.247 - Notification of Termination or Other Change of Service

(A) A service shall give written notice in accordance with 105 CMR 170.247(B) of the following types of changes with regard to its service delivery:
(1) Termination of services;
(2) Change in the level of service delivered
to a service zone or local jurisdiction;
(3) Temporary cessation of services;
or
(4) Sudden event that interferes
with the level of service it can provide.

(1)
Notice of changes in
105
CMR 170.247(A) must be
provided in writing to the following entities:
(a) the Department;
(b) the appropriate Regional EMS Council;
and
(c) the service zone in which
it operates or in which it is a designated provider, and prior to the existence
of service zones, the appropriate local jurisdiction(s).
(2) Notice of changes in
105
CMR 170.247(A)(1) and (2)
must be provided at least 90 calendar days prior to the effective date of the
change, or as soon as the service is aware of the need for the termination or
change.
(3) Notice of changes in
105
CMR 170.247(A)(3) and (4)
must be provided as soon as the service is aware of the need for the
change.
(4) A notice of changes in
service delivery shall be accompanied by a plan to prevent a disruption in EMS
service, subject to the approval of the Department.
