Title 105 CMR 158.000 - Licensure of Adult Day Health Programs

(A) The Department shall determine the licensed program capacity for a Program based on the square footage of the participant area as specified in 105 CMR 158.045(B). As used in 105 CMR 158.026, licensed program capacity is not a form of a license within the meaning of M.G.L. c. 30A, § 13.
(B) In cases where a permanent reduction or a temporary reduction of the square footage of the participant area is necessary for any reason:
(1) A Program shall notify the
Department in writing of the reduction in square footage, the reason for the
reduction in square footage, and the estimated length of time of the reduction
in square footage; and
(2) On
receipt of this notification the Department will establish a revised licensed
program capacity or take other such actions as the Department determines
appropriate.
