Subpart C - SUPPLEMENTARY STANDARDS: IN GENERAL
Section 130.313 - Licensed Mental Health Professionals in Emergency Departments or Satellite Emergency Facilities

(A) A hospital shall ensure that a sufficient number of licensed mental health professionals are available at all times in an emergency department or a satellite emergency facility to assess, evaluate and stabilize, either in person or via telehealth, or electronic or telephonic consultation, a person who presents with a primary mental health concern, and, if appropriate, to refer such person for appropriate follow up, treatment or inpatient admission.

Individuals with a master's degree in a clinical behavioral health practice pursuing licensure post master's under the supervision of an appropriately licensed and credentialed clinician may be considered a "licensed mental health professional" for purposes of 130.313.

(B) A hospital with an emergency department or satellite emergency facility must establish policies and procedures for an expedited assessment, evaluation and stabilization process for a person younger than 22 years old presenting with a primary mental health concern.
