Pursuant to M.G.L. c. Ill, § 25G, the superior and supreme judicial courts shall have jurisdiction, upon request of the Department, or of any Ten Taxpayer Group in Massachusetts to enforce any provision of 105 CMR 100.000. A violation of any such provision shall subject the violator to liability for a civil penalty of not more than $500 for each day of such violation, assessable by the superior court. A violation of any such provision shall constitute grounds for refusing to grant, renew, modify, or revoking the license of a Health Care Facility or of any part thereof.
