Section 21.10.06.09 - Prehearing Briefs

The Appeals Board may require the parties to submit prehearing briefs in any appeal in which a hearing has been elected pursuant to Regulation .08 of this chapter. In the absence of an Appeals Board requirement for this, either party may furnish a prehearing brief to the Appeals Board, upon appropriate and sufficient notice to the other party, at least 30 days before the date set for the hearing. When a prehearing brief is submitted, it shall be furnished so as to be received by the Appeals Board at least 15 days before the date set for the hearing, and a copy simultaneously shall be furnished to the other party. Prehearing briefs shall not exceed 15 8.5 x 11 inch typewritten doublespaced pages, excluding exhibits thereto.
